Effective Date: January 1, 2026

1. Definitions

  1. Service — the web application Kalkulator Remontu AI available at https://kalkulatorremontu.web.app.
  2. Operator — Gmbi Marek Papis, ul. Pomorska 70 m. 10, 91-409 Lodz, Poland, NIP: 9820319917.
  3. User — any person using the Service.
  4. Account — an individual User account in the Service, created upon registration or automatically as an anonymous account.
  5. Anonymous User — a person using the Service without registration, with a temporary Firebase account. Data is stored locally only.
  6. Registered User — a person who created an Account with an email address and password.
  7. PRO User — a Registered User with an active PRO Subscription, receiving additional Points.
  8. Company Account — an Account designated as a business account, with additional business features.
  9. Company PRO Account — a Company Account with an active PRO Subscription.
  10. Points — virtual service credits enabling the use of paid features. Points have no monetary value and cannot be exchanged for cash.
  11. PRO Subscription — a paid annual or monthly subscription providing access to advanced features and additional Points.
  12. Project — a data set describing a renovation or construction job, containing rooms, materials, labour, equipment, and configuration.
  13. Template — a predefined Project serving as a starting point for new Projects.
  14. AI Analysis — a feature using artificial intelligence models (provided by OpenAI, LLC) to analyze photos or project descriptions.
  15. Stripe — the third-party payment processor handling transactions in the Service.

2. Acceptance of Terms

  1. By accessing or using the Service, you agree to be bound by these Terms of Service. If you do not agree, you must not use the Service.
  2. The Operator reserves the right to modify these Terms. Continued use of the Service after changes are posted constitutes acceptance of the modified Terms.
  3. You must be at least 16 years of age to use the Service. If you are under 18, you represent that you have your parent's or legal guardian's permission to use the Service.

3. Services and Features

3.1 Free Tier

All Users may:

  • browse and edit Projects locally (Anonymous Users),
  • use the renovation cost calculator,
  • view pie/bar chart cost summaries,
  • use the Q&A panel,
  • view cost estimates.

3.2 Points System

The following operations require Points:

Current operation costs are displayed in the Service and are subject to change.

3.3 PRO Subscription

The PRO Subscription provides:

  • access to advanced features (project sharing, estimation config, margin/VAT settings, PDF templates),
  • additional Points included (current amount displayed in the Service),
  • reduced Point costs for operations,
  • project duplication,
  • public project links (Company PRO Accounts).

4. Account Registration

4.1 Anonymous Account

  1. Users may use the Service without registration.
  2. An Anonymous Account is created automatically via Firebase Authentication.
  3. Data entered by Anonymous Users is stored locally only and is not saved to the server.
  4. Anonymous Users receive an initial pool of Points (current amount displayed in the Service).
  5. Features requiring server storage (e.g., export, sharing) are not available to Anonymous Users.

4.2 Registered Account

  1. Registration requires an email address and password.
  2. A verification email is sent upon registration.
  3. Registered Users receive an initial pool of Points (current amount displayed in the Service).
  4. Converting an Anonymous Account to a Registered Account preserves existing local data.

4.3 Company Account

  1. Company Accounts are intended for contractors and construction businesses.
  2. Company Accounts receive an initial pool of Points (current amount displayed in the Service).
  3. Company Accounts enable: XLS import/export, price management, staff and client management, element library.
  4. Users may designate their Account as a Company Account by providing business details (Tax ID, address, website).

5. Payments

5.1 Payment Processor

  1. Payments are processed by Stripe, Inc. (https://stripe.com).
  2. The Operator does not store credit card data — all payment information is processed exclusively by Stripe in compliance with PCI DSS standards.

5.2 Available Payment Methods

  • Credit/debit card (Visa, Mastercard, and others supported by Stripe),
  • BLIK (Poland),
  • Przelewy24 / P24 (Poland).

PRO Subscriptions are available with card payments only.

5.3 Pricing

Current prices for PRO Subscriptions, Points Packages, and other paid services are displayed in the Service and are subject to change. All prices include applicable taxes.

5.4 PRO Subscription Terms

  1. The PRO Subscription auto-renews for subsequent periods (monthly or annual) until cancelled.
  2. Cancellation is available at any time through the Stripe Customer Portal.
  3. After cancellation, PRO access remains active until the end of the current billing period.
  4. Unused Points from a subscription do not carry over to the next period and are non-refundable.

5.5 Points Terms

  1. Points are virtual service credits with no monetary value.
  2. Points cannot be exchanged for cash or transferred between accounts.
  3. Unused Points do not expire (except Points from PRO Subscriptions).
  4. The Operator reserves the right to modify Point costs with 30 days' advance notice.

6. Project Sharing

6.1 Access Levels

  1. Owner — full access to the Project, manages sharing.
  2. Admin (Shared Admin) — can edit the Project, assign access, export XLS (if PRO).
  3. Editor (Shared Editor) — can edit within visibility flags set by the Owner.
  4. Reader (Shared Reader) — read-only access within visibility flags set by the Owner.

6.2 Responsibilities

  1. The Project Owner is responsible for managing access to their Project.
  2. The Operator is not liable for the consequences of sharing a Project with third parties.
  3. Project sharing requires a PRO Subscription and costs 1 Point per access assignment.

7. AI Analysis

  1. The Service offers AI analysis features powered by artificial intelligence models provided by OpenAI, LLC.
  2. When using AI analysis, data (photos, project descriptions) is transmitted to OpenAI servers for processing.
  3. AI analysis results are approximate and do not constitute professional construction, architectural, or engineering advice.
  4. The Operator does not guarantee the accuracy, completeness, or usefulness of AI analysis results.
  5. Users rely on AI analysis results at their own risk.
  6. AI analysis costs: 5 Points for photo analysis, 5 Points for description analysis.

8. Intellectual Property

8.1 Operator's Property

  1. The Service, its source code, visual design, templates database, and configuration data are the intellectual property of the Operator.
  2. Users do not acquire any intellectual property rights to the Service.
  3. Copying, modifying, or distributing elements of the Service without the Operator's consent is prohibited.

8.2 User Content

  1. Users retain all intellectual property rights to content they submit to the Service (project descriptions, photos, notes).
  2. Users grant the Operator a non-exclusive, royalty-free, worldwide license to store and process User content solely for the purpose of providing the Service.
  3. When using AI analysis, User content is transmitted to OpenAI in accordance with their data processing terms.

8.3 DMCA Compliance

If you believe that content on the Service infringes your copyright, please send a notice to airenovationcalculator@gmail.com containing:

  • identification of the copyrighted work,
  • identification of the infringing material,
  • your contact information,
  • a statement of good faith belief that the use is not authorized,
  • a statement under penalty of perjury that the information is accurate,
  • your physical or electronic signature.

9. Limitation of Liability

  1. The Service is intended for approximate renovation and construction cost estimation. All estimates and calculations generated by the system are approximations only and may contain errors. Calculation results do not constitute a commercial offer, a formal construction cost estimate under applicable building laws, or professional technical advice.
  2. The Operator shall not be liable for incorrect, inaccurate, or erroneous calculations generated by the system, including any malfunction of the price calculation, cost estimation, or material quantity computation features. Users rely on calculation results at their own risk and should verify them with a professional cost estimator or contractor.
  3. THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
  4. The Operator shall not be liable for:
    • the accuracy of cost estimates generated by the Service,
    • construction or renovation decisions made based on Service data,
    • financial losses resulting from differences between estimates and actual costs,
    • AI analysis results,
    • service interruptions caused by factors beyond the Operator's control (e.g., server outages, payment processor downtime),
    • data loss caused by force majeure.
  5. IN NO EVENT SHALL THE OPERATOR'S TOTAL LIABILITY EXCEED THE AMOUNT PAID BY THE USER FOR SERVICES IN THE 12 MONTHS PRECEDING THE CLAIM.
  6. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES OR LIMITATION OF LIABILITY. IN SUCH CASES, THE ABOVE LIMITATIONS APPLY TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW.

10. Indemnification

You agree to indemnify, defend, and hold harmless the Operator and its officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with:

  • your use of the Service,
  • your violation of these Terms,
  • your violation of any third-party rights,
  • any content you submit to the Service,
  • any construction or renovation decisions made based on data from the Service.

11. Dispute Resolution

11.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Poland, without regard to conflict of law provisions.

11.2 Informal Resolution

Before filing any formal proceedings, both parties agree to attempt to resolve disputes informally by contacting airenovationcalculator@gmail.com. The parties shall endeavour to resolve the dispute within 30 days.

11.3 Binding Arbitration

If informal resolution fails, any dispute arising from or relating to these Terms or the Service shall be resolved by binding arbitration under the rules of the Court of Arbitration at the Polish Chamber of Commerce (Sad Arbitrazowy przy Krajowej Izbie Gospodarczej), unless the User qualifies as a consumer under applicable law. Consumers retain the right to bring claims in their local courts.

11.4 Class Action Waiver

To the fullest extent permitted by law, you agree that any dispute resolution proceedings will be conducted on an individual basis and not as a class, consolidated, or representative action.

12. Complaints

  1. Users may submit complaints regarding the Service to airenovationcalculator@gmail.com.
  2. Complaints should include: User's email address, description of the issue, and expected resolution.
  3. The Operator will process complaints within 14 days of receipt.
  4. Responses will be sent to the User's email address.

13. Right of Withdrawal (EU Consumers)

13.1 PRO Subscription

  1. Consumers (natural persons making purchases unrelated to business activity) within the EU have the right to withdraw from the subscription agreement within 14 days of the agreement date, without giving a reason, pursuant to EU Directive 2011/83/EU and applicable local consumer protection laws.
  2. Withdrawal statements should be sent to airenovationcalculator@gmail.com.
  3. Upon valid withdrawal, the Operator shall refund the payment within 14 days.

13.2 Points Purchase

  1. Points constitute digital content not supplied on a tangible medium.
  2. By consenting to the commencement of service before the withdrawal period expires and acknowledging the loss of the right of withdrawal, the consumer waives the right to withdraw from the Points purchase in accordance with applicable consumer protection laws.
  3. Such consent is obtained during the Points purchase process.

14. Account Deletion

  1. Users may delete their Account in the Service settings (Settings > Delete Account).
  2. Account deletion is irreversible.
  3. Upon deletion:
    • User profile data is removed from the database,
    • Projects owned solely by the User are deleted,
    • shared Projects remain available to other Users,
    • unused Points are forfeited without refund,
    • active PRO Subscriptions are cancelled (without refund for the unused period).
  4. Anonymous User data is deleted no later than 24 hours after account creation. The Operator may delete inactive Anonymous Accounts at any time.

15. Changes to Terms

  1. The Operator reserves the right to modify these Terms.
  2. Registered Users will be notified of changes via email or in-Service notification at least 14 days before the changes take effect.
  3. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
  4. Users who do not accept the changes may delete their Account.

16. Miscellaneous

  1. If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
  2. The Operator's failure to enforce any right or provision shall not constitute a waiver of that right or provision.
  3. These Terms constitute the entire agreement between the User and the Operator regarding the Service.
  4. These Terms are effective as of January 1, 2026.

The Service uses the following third-party services:
